A search for a missing Tulsa toddler turns into a custody case. Tulsa Police investigators say the 4-year old disappeared from his west Tulsa home around 1 PM Wednesday.

Police found the boy about an hour later playing alone near the Arkansas River. When officers arrived at the boys' home, they say they found it to be unfit for raising children.

The 4 year old and his six-month-old brother were put into the custody of the state. Tulsa Police Sgt Wayne Allen, "The officers that were inside the home, one officer told me it was some of the worst living conditions she had ever observed, there's animal defecation throughout the house, she said she could not take a step anywhere without stepping into something."

No charges have been made against the boy's parents. It will be up to the State Department of Human Services to determine whether the boys can be returned to their home.
