OKLAHOMA CITY (AP) _ Police have completed their investigation of the shooting death of a 10-year-old El Reno boy and have turned the evidence over to the Canadian County prosecutor.
The prosecutor will now decide whether there is enough evidence to charge the victim's playmate with murder.
Tremain Richey's mother found the boy dead in his backyard Aug. 5. The death shocked the small town and even more jolting was that fact that Richey's 10-year-old playmate was the primary suspect.
Police said the boys fought about a sports team before Richey was shot.
Police said they are still trying to figure out where the boy may have gotten the gun.
The playmate was arrested Aug. 7 on a murder complaint. If charges are filed, the boy will be charged as a juvenile since he is under 12, according to state law.
Since the suspect is a juvenile, very little information has been released about the case.
The boy was being held in the Canadian County juvenile justice center, but because criminal proceedings against a minor are confidential it is unclear if the boy is still there.
