(Tulsa-AP) -- The state Court of Criminal Appeals has upheld the murder conviction and death sentence of a man who fatally shot a Sapulpa convenience store clerk more than a decade ago.
But the court has reversed Darrin Lynn Pickens' conviction and ten-year sentence for possession of a firearm in connection with the 1990 robbery-murder of clerk Tommy Lee Hayes.
Pickens was convicted of first-degree murder in the slaying of Tina Sue Wolf at a convenience store five days after Hayes' death. Last March, the 10th U-S Circuit Court of Appeals upheld the conviction but overturned the death sentence.
The new sentencing trial in the Wolf case has been set for September tenth.
