Judge moves child abuse trial because of publicity

(Jay-AP) -- The trial for a man accused in the fatal beating of his foster son has been moved for the second time.

A Delaware County Judge decided pretrial publicity may have tainted a local jury pool in the trial of James Clayton Milhollin.

Milhollin's trial has been moved to neighboring Craig County. The trial is scheduled to begin October Tenth.

Thirty-three-year-old Milhollin, of Miami, is accused in the July 1998 beating death of his five-year-old foster son, Michael Buxton.

Milhollin's first trial was in Ottawa County. But a mistrial was declared in November after a prospective juror admitted telling two other jurors he was certain of Milhollin's guilt because he knew the victim's mother.

Shelly Milhollin -- Milhollin's ex-wife -- is charged with felony child abuse. She's expected to be the state's key witness against her ex-husband.
