OKLAHOMA CITY (AP) -- An Oklahoma County district judge has reinstated an embezzlement charge against former state Insurance Commissioner Carroll Fisher.
The case involves a thousand dollar campaign check Fisher deposited into his overdrawn personal bank account in May 2003.
The former insurance commissioner had begun his 2006 re-election campaign, but never reported the contribution.
He returned the check after he was charged last year.
Special Judge Fred Doak threw out the charge Dec. 22 on legal grounds. Prosecutors challenged his ruling to Judge Ray Elliott.
Fisher, a Tulsa Democrat, resigned September 24th rather than face an impeachment trial in the state Senate. He was insurance commissioner nearly six years. He faces five charges.
