DENVER (AP) -- Colorado's Supreme Court is refusing to hear an appeal from former Denver Broncos linebacker John Mobley, who was sentenced to seven days in jail for a drunken driving conviction.

During Mobley's trial in April 2004, defense attorneys implied that his conviction was the result of racial profiling.

They argued that Mobley, who was released by the Broncos in late July 2004 because of a lingering neck injury and hasn't returned to the NFL, failed the sobriety test because of a concussion and other football injuries. Mobley testified he had been pulled over
at least 12 times during the 12 months before his arrest.

Prosecutors had said Mobley wouldn't have to serve his sentence until his appeal was complete. It's not clear as to when he might be jailed.
