The parents of a Tulsa boy are suing after an underage driver killed their son in September of last year. It's hard to forget the story and the face of 11-year old Fabian Saenz. Tulsa Police say a 15-year-old girl was behind the wheel of the car that killed the boy while he was mowing the front lawn of his home.
Now his parents are suing the 15-year-old's parents. Armando and Guadalupe Saenz filed the lawsuit Monday in Tulsa County District Court. In the suit, the Saenz’ are asking for actual and excess damages, exceeding $10,000. The teen and her parents, Alfreda Bagby and Keith Warren were named in the lawsuit.
Tulsa Police say the 15-year-old was driving about 60 miles an hour in a 25 mile an hour zone with other kids in the car.
The teen was charged with second-degree murder under youthful offender guidelines, but lawyers agreed to move her case to juvenile court. A Tulsa County District Court judge said proceedings there will be confidential.
The 15-year-old's aunt will spend some time behind bars. Rebecca Warren received a 4-year prison sentence for letting underage kids drive her car.
