The Creek County district attorney has decided not to file charges in an October triple shooting that killed one man and wounded two other people.
One of the victims, whose brother was killed in the October shooting, says she's stunned by the decision. The shooting happened after a party at a home near Sapulpa. A fight broke out over a dent in host Chris Vanmeter's car.
19-year old Diane Cloud says she, her brother Dakota and a friend were leaving, when Vanmeter came out of his house and shot them all, killing Dakota. Investigators say Vanmeter told them he was acting in self-defense.
Creek County DA Max Cook: "The decision has been made not to file any charges at least at this time against Mr. Vanmeter based upon the information we have, he was in his house, people were trying to break in."
Cook says this is supported by evidence and witnesses at the scene and that the shooting falls under Oklahoma's ‘Make My Day’ law. Cloud says Vanmeter's life was never in danger.
The DA says the case is still open for review and if new evidence comes to light, charges could be filed.
