A man charged with murdering a Tulsa bank teller during a robbery wants jurors to decide if he is mentally stable enough to be executed.

Alvin Jordan and two other men are charged with first degree murder in the death of Amber Rogers. Rogers was killed during a robbery of First Fidelity Bank in June of 2004.

Prosecutors are seeking the death penalty, but Jordan's attorney is asking for a jury trial on whether he's mentally handicapped under the law. The US Supreme Court ruled it's unconstitutional to execute the mentally retarded.

A Tulsa psychologist who examined Jordan says he appears to be trying to fake a mental illness.
