NORMAN, Okla.(AP) -- Attorneys for a man accused of killing a University of Oklahoma ballet student want blood samples used to obtain a DNA profile suppressed.
27-year-old Anthony Sanchez is set to go on trial January 30th on charges of first-degree murder, kidnapping, sodomy and rape stemming from the 1996 death of Jewell "Juli" Busken.
In a motion filed last week, defense attorneys argued that Sanchez's right to privacy was violated when a blood sample was taken from him while he was serving time in prison on an unrelated charge.
The blood sample was used to develop a DNA profile which prosecutors say matches a DNA profile developed from a semen sample from Busken's clothing when her body was found at Lake Stanley Draper.
Defense attorneys contend the state had no reason to take the blood sample from the 27-year-old Sanchez because he wasn't a suspect then.
