Robbery and assault charges have been dropped against 45-year-old Frank Burks.

That's because a key witness in the case refused to testify. Records show Burks was also acquitted of attempted murder and robbery charges last year after a witness in the case died before the trial.

The charges stemmed from the death of 77 year old Donald Stout Senior. Stout died from injuries he received after being attacked in his Tulsa apartment in 2002.
