WOODWARD, Okla. (AP) -- A Woodward County judge plans to rule June 1st whether the attorney for a woman charged with first-degree murder in the disappearance of her 6-year-old son should be removed from the case.
Associate District Judge Joseph Marak heard testimony Tuesday on a motion by prosecutors to have defense lawyer David Christian dismissed as the attorney for Katherine Pollard.
Pollard's son, Logan Tucker, disappeared in June 2002. Law enforcement officers are searching the Woodward County Landfill by hand for the boy, who is presumed dead.
Prosecutors voiced concern about Christian's relationship with his client. They pointed to videotape in which Pollard said, among other things that she and her attorney "made out" out a hotel room and that she planned to pay his fee with proceeds from movie rights to her story.
Special prosecutor Chris Ross says if the allegations are true, they are they could pose a conflict of interest.
Christian says the recordings were illegally obtained because Pollard was questioned without counsel present.
