A man accused of raping a Glenpool girl is headed to prison, but for a different crime.
A federal judge sentenced Kevin Smith to 17-and-a-half years in prison Wednesday for distributing and possessing child pornography.
Smith was convicted in September of having 290 images of child porn and 143 videos on his computer.
The prosecutor said Smith did not create any of the porn, but got it off the Internet then used a file sharing program to distribute the child porn.
Smith was also ordered to pay a $25,000 fine and $1,000 in restitution to the victims of child porn.
"Some of the images he possessed were of actual children that suffered real, intangible harm and as a result he's going to be paying restitution to some of those victims,” said Assistant U.S. Attorney, Jeff Gallant.
Smith also is charged with kidnapping and sexually assaulting a 12-year-old Glenpool girl nearly two years ago.

Then, last March, Tulsa detectives said Smith told two girls who were selling Kool-Aid in their driveway that they could make money by going with him to a studio to take pictures.
That scared the girls away, but they saved the cup Smith drank from and gave it to police.

Detectives said Smith's DNA was found on the cup and then linked to the Glenpool assault.
Investigators wouldn't have known who the DNA belonged to until Smith was arrested last summer on the child porn charges and took a sample and connected the cases.
Smith will not be charged for the incident at the lemonade stand.
His trial date in the Glenpool case has not been set.
