A federal jury in Tulsa has convicted a man of attempting to rob a Miami, Oklahoma bank but couldn't reach a verdict on whether he was guilty in the death of a truck driver who crashed while trying to avoid the suspect's vehicle during a subsequent police chase.

A jury convicted Francis Dishmon on Friday of attempted bank robbery for the August 28, 2013 incident at IBC Bank in Miami. The Miami News Record reported Dishmon is scheduled for sentencing March 9, 2015.

Authorities say Dishmon handed a teller a note demanding cash but drove away without any money.

Just north Quapaw, the Oklahoma Highway Patrol said Dishmon tried to pass a semi that was carrying orange juice. Troopers said the semi driven by James Wivell of Longmont, Colorado lost control, rolled onto its side and into a ditch. Wivell was pronounced dead at the scene

Court records show federal prosecutors plan to retry Dishmon in Wivell's death.
