MUSKOGEE, Okla. (AP) -- Motions filed in the case of a man accused of fatally stabbing the mother his 10-month-old son lead to a delay of his preliminary hearing. A hearing for Enrique Pacheco, 18, was set to begin on Tuesday. A Muskogee County judge put off the hearing until November 13 after Pacheco's attorney, Lloyd Payton, filed paperwork on Monday to suppress the police report, DNA and other issues.
Prosecutors allege Pacheco fatally stabbed Lisa Poor Bear at a Muskogee motel August 13.
Muskogee County Assistant District Attorney James Walters said some of the discovery items sought by the defense do not have to be submitted until after the preliminary hearing. But both sides plan to try to reach an agreement, Walters said.
Pacheco remains jailed without bond.
Poor Bear is the adopted daughter of Lisa Tiger, who is a member of a prominent American Indian artist family.
