Tulsa County prosecutors have dropped a murder charge against 18-year-old Rico Starks for a second time. Prosecutors say they do not have enough evidence to send him to trial.
Starks had faced a second degree murder charge in the August 2006 killing of Mark Jordan, who was shot and killed after a street fight near 5600 N. Garrison Court, police said. That charge was dropped on Friday.
This is the second time a murder charge has been dropped against Starks in this case. In June the Tulsa County District Attorney dropped a murder charge against Starks because a key witness failed to testify. The charges were refilled a day later.
Police say evidence shows at least three people fired guns that night. Nineteen year old Cedric Howard is awaiting trail on a second degree murder charge in the case, and a murder charge against Jerrico Thomas was dropped in December.
