TULSA, Okla. (AP) -- State Representative John Trebilcock of Broken Arrow is pleading no contest to a misdemeanor driving under the influence charge as part of a plea deal. As part of the deal Trebilcock must complete terms of probation in the next six months then would be allowed to withdraw the plea and plead to a reduced charge of reckless driving.

Trebilcock was arrested early March 31st in Tulsa after a police officer stopped him for driving without headlights and he refused to take a breath-analyzer test.

Police say he told the officer he had two drinks and smelled of alcohol because he kissed a girl who had been drinking.

Trebilcock's attorney says Trebilcock was not intoxicated and made the comment about kissing a girl as a joke.
