(Oklahoma City-AP) -- An Oklahoma County judge has dismissed a defamation lawsuit filed by the Warr Acres fire chief against the city's mayor and a former mayor.

Oklahoma County District Judge Bryan Dixon dismissed the lawsuit last month because Fire Chief Bob Cunningham failed to subpoena Mayor Marietta Tardibono and other defendants within 90 days.

Cunningham was seeking more than ten-thousand dollars in damages. He claimed Tardibono and former Mayor Chris Wood lied when they said he falsified work-related injuries.
