(Denver-AP) -- An alleged rape victims wants the Tenth US Circuit Court of Appeals to reverse a lower court's decision to throw out a lawsuit against Stillwater police.

Alison Jennings announced the lawsuit in a press conference in 2001. She says four former Oklahoma State University football players raped her at a party in November 1999.

All four men said they had consensual sex with her.

In videotaped interviews with a Stillwater police officer, Jennings repeatedly said she couldn't remember details of the event and she thought she'd drop the issue.

But her lawsuit alleges that a police detective made false statements that convinced her to sign a waiver of prosecution. Jennings' attorney, Mark Hammons, says the waiver led to evidence being destroyed.

That evidence, he says, would have strengthened Jennings' lawsuits against the football players. Jennings has settled two of the lawsuits, and she won judgments in the other two.
