An 18-year-old accused of killing a Tulsa convenience store clerk could get the death penalty if convicted. That's the word from a Tulsa County judge.
Attorneys for Darrel Miller wanted to delay his trial until the US Supreme Court could decide if asking for the death penalty against Miller was cruel and unusual punishment. Miller was 17 at the time of the murder. He’s charged with the August murder of Paul Silkey.
Silkey was an assistant store manager at a Git-N-Go store. Miller's also accused of a string of violent robberies in June and July.
His case is scheduled to go to trial October 18th.
