(Denver-AP) -- An attorney says a man who killed a Tulsa mail carrier worker should be released from federal custody because a mental disorder that prompted the killing was temporary.
Jason Weed was found innocent on an insanity defense in the December 2001 killing. He's being held in a federal hospital.
Assistant federal public defender Barry Derryberry says Weed shows no symptoms of the psychotic episode he had when he shot Robert Jenkins.
Derryberry today asked the Tenth U-S Circuit Court of Appeals in Denver to release Weed because he is no longer a risk to people or property.
Prosecutor Kevin Danielson says Weed's own psychologist determined Weed had an underlying mental defect that caused the psychotic episode.
The prosecutor says there is still a risk of Weed having another episode.
