The battle over a close Tulsa city council election may go to the state Supreme Court. Friday morning a Tulsa County District Court judge turned down a lawsuit over voter fraud in the election.
Thursday, the election board re-counted the ballots in the district 3 council race. It confirmed that David Patrick won - and Roscoe Turner lost. Turner believes - and several Republicans confirm - they voted in the Democratic primary - when they should not have been given a ballot.
Republican voter Eva Passmore: "And I'm just frustrated because, they gave us all Democratic ballots. They want to act like it never happened and it happened."
Turner believes there was enough of those voters to call into question the outcome of the election, which by Thursday’s count - was won by just 3 votes.
