(Sallisaw-AP) -- The owners of Blue Ribbon Downs plan to try to block a foreclosure auction of the Sallisaw racetrack.

Robert Inglish, attorney for the track owners, says he'll file paperwork with the state Supreme Court Thursday to stop the auction, planned for November 4th.

Inglish says there can't be a foreclosure until Blue Ribbon Downs' against the city of Sallisaw are heard.

The company and the city claim the other party is in breach of contract. The company owes the city about $2.8-million.

In 1995, the city bought the track and sold it back to the company that operates the track. But court documents state the company hasn't made a payment on the debt since 2001.
