We are learning more about a lawsuit filed by a Tulsa family against the Laureate Psychiatric Clinic.

Ben Bailey and his attorney held a news conference Tuesday. They say Bailey's 56-year-old mother was raped by a fellow patient at the clinic back in February. Bailey says his mom was at Laureate for a psychiatric evaluation and treatment and the hospital failed to protect her.

Tulsa Police took a report in the case but say no criminal charges will be filed. But Bailey still believes his mom was sexually assaulted. "She was already incapacitated and she couldn't make that type of call on her own at all.â€

The hospital says federal privacy laws prevent it from responding to the allegations.
