(Oklahoma City-AP) -- A state judge said Wednesday Oklahoma City bombing conspirator Terry Nichols should face two additional murder charges.
Nichols now faces 162 state charges of first-degree murder.
District Judge Allen McCall added the charges for the deaths of two unborn children a day after deciding Nichols should stand trial on state charges.
McCall says bombing victims Robin Huff and Carrie Ann Lenz were carrying unborn children who could have survived outside the womb. Huff was 32 weeks pregnant and Lenz was 26 to 28 weeks pregnant.
A state appeals court ruled last year that fetuses are viable at 24 weeks and that causing the death of a fetus can be charged as first-degree murder.
Nichols is already serving life in prison on federal convictions.
The state charges involve victims who were not part of the federal case and prosecutors say they'll seek the death penalty.
