(Oklahoma City-AP) -- The state's appeal of an injunction against no-smoking regulations will be heard in Tulsa.
The Oklahoma Supreme Court assigned the case to the Court of Civil Appeals in Tulsa.
The state is appealing a ruling by Creek County Judge Donald Thompson that the state Health Department overstepped its authority when it issued rules regarding smoking.
The rules require restaurants with no-smoking sections and seating for 50 or more to provide separately ventilated areas for smokers.
A restaurant owner and a VFW post filed the Creek County lawsuit challenging the rules.
