The same technology that exonerated one man of rape is now making it possible to prosecute another for the crime.
Arvin McGee was released earlier this year when DNA evidence proved he did not rape a Tulsa woman ten years ago. Now, the district attorney has filed charges against a convicted felon for the crime.
Using the state's bank of DNA profiles, the state says the evidence points to Edward Alberty. DA Tim Harris says this technology protects the innocent like McGee and provides justice for victims. "I was happy when the DNA proved that he was innocent and I was able to join with the defense and get him out as quickly as we possibly could by the same token the victim and I've spoken with her and she's also very glad that we'll be able to go forward with this."
Alberty is currently serving a 30-year sentence for second-degree rape and other crimes.
