(Alexandria, Virginia-AP) -- The judge in the Zacarias Moussaoui case wants an explanation from the FBI.
She's demanding to know how the bureau could've missed evidence of an e-mail account the accused nine-eleven conspirator says he used in the weeks before the attacks. He say he used it on several computers, including one at a Kinko's store in Minnesota.
The FBI had said it examined all the computers in question, but prosecutors say Kinko's each day erases files on the computers it rents to the public.
Prosecutors also have a sworn statement by a Microsoft worker that the company couldn't find records of the e-mail account on its Hotmail service. But the worker notes Hotmail accounts expire after 90 days of no use.
The judge says the government's intense probe of Moussaoui means investigators should've found evidence of the account before it expired.
