(Oklahoma City-AP) -- Oklahoma Attorney General Drew Edmondson plans to ask for an execution date for convicted killer Samuel Van Woudenberg.

The U-S Supreme Court today denied Van Woudenberg's final appeal.

Van Woudenberg and Terrance James were convicted and sentenced to die for strangling Mark Berry to death in the Muskogee jail in 1983. Van Woudenberg was jailed on a federal kidnapping charge at the time.

A spokesman in the attorney general's office says an execution date for James is pending.

Both men can still file emergency appeals.
