(Oklahoma City-AP) -- Condemned killer James Patrick Malicoat decided today that he didn't want to go to execution quietly, after all.

Malicoat's attorney has filed an appeal on his behalf in federal court. This comes after Malicoat had earlier waived his right to appeals.

Malicoat was convicted of first-degree murder for slaying his 13-month-old daughter at his Chickasha home in 1997.

He is scheduled to be executed February 20th.
