(Tulsa-AP) -- A judge says an Okmulgee man is mentally competent to stand trial in the May Second shooting death of his brother. Tulsa County Special Judge Clancy Smith made his ruling Thursday in the case of 25-year-old Daniel David Film.

Police found 22-year-old John Joshua Film dead in his Tulsa apartment with multiple gunshot wounds to the head. Smith based his ruling on a court-appointed psychologist's report. The psychologist reported that Daniel Film told police he shot his brother because God wanted him to quote "get rid of the devil in the world."

The psychologist reported that Daniel Film became psychotic in September 1999. But the psychologist determined that Film can appreciate the nature of the charge against him, can consult with his lawyer and can aid in his own defense. A preliminary hearing has been scheduled for August 24th.
