(Jay-AP) -- A Rogers County prosecutor will handle the case against a former Delaware County sheriff's deputy accused of perjury and evidence tampering.
The state Attorney General's office appointed the prosecutor after Ottawa County Assistant District Attorney Fred DeMier filed a motion to disqualify his office.
DeMier cited a conflict of interest between Delaware County District Attorney Thomas H. May and one of the witnesses. Bill Stout's case will move to Ottawa County with a preliminary hearing on August 29th.
Stout is accused of two counts of perjury and two counts of falsifying evidence in connection with a 1998 methamphetamine raid in Grove. He has pleaded innocent and is free on four-thousand dollars bail.
