(Santa Fe, New Mexico-AP) -- An Oklahoma man under investigation in the 1976 disappearance of his mother has sued a Santa Fe police detective who pursued the case for seven years.

Doug Foote of Sapulpa, Oklahoma, alleges that recently retired Detective Mark Clayton intentionally made false and misleading statements to Oklahoma Courts and prosecutors.

Foote wants a federal court in Tulsa, Oklahoma, to prohibit some D-N-A tests on him.

Santa Fe police want to compare his D-N-A to that of skeletal remains unearthed in 1993 from beneath a rose bush at a Santa Fe home.

Clayton has said D-N-A tests should determine whether the remains are those of Foote's mother, Donna.
