(Muskogee-AP) -- A Fort Gibson man is in custody after being arrested for the hit and run death of a Porter bicyclist. Thirty-three-year-old Brian Phillips was arrested on a routine traffic stop by Muskogee police Tuesday.
Phillips is in custody ona second-degree murder complaint and driving under the influence. Other complaints against Phillips include driving under suspension, possession of marijuana and drug paraphernalia and leaving the scene of a fatality accident.
Twenty-one-year-old Richard Allen Peak the second was riding a bicycle when he was hit from behind. Peak later died in a Muskogee hospital. Phillips is being held without bond at the Muskogee County/City Detention Facility pending an initial appearance today in Muskogee District Court.
