Tulsa Police and the Tulsa County DA's office are upset that a judge agreed to let an accused murderer out of jail Saturday for a funeral.
Andre Banks is being held without bond in the Tulsa County jail on a charge of first degree murder. He has a past 15 year sentence for armed robbery and a three year sentence for escape.
Tulsa Police say he's also a certified gang member. However, Tulsa County District Court Judge Caroline Wall agreed to let him leave jail Saturday at 10 AM and travel to Okmulgee for his mother's funeral with only a private eye to watch him. Banks is supposed to be back in jail by 3 PM.
District Attorney Tim Harris says his office objected to the decision because of their grave concern to public safety.
