The News on 6 is learning more about the man killed by his brother Sunday in Wagoner County.

Court records show the Oklahoma State Bureau of Investigation is looking into a shooting that killed a man just north of Muskogee in Wagoner County.

Investigators say Roy Dillingham was loading cattle into a trailer on his family's property when his brother Troy showed up. That's when authorities say the two men started arguing and Roy shot his brother Troy twice in the chest with a 38-caliber pistol.

Troy Dillingham[pictured] died at the scene. Sheriff deputies say the two brothers have had problems with each other in the past, but Roy Dillingham recently took steps to deal with the situation.

Wagoner County Sheriff Rudy Briggs: "There is a protective order against the victim from the suspect. It was issued several months ago. It's sort of been an ongoing feud between them."

Investigators say Roy is claiming self-defense and they released him after questioning.

Roy Dillingham is the father of Daniel Dillingham, the teenage boy who was convicted of stabbing a fellow student to death on a Porter bus last year.
