A federal judge has been asked to delay the trial of a man accused of killing an Oklahoma Highway Patrol trooper.

US Attorneys and a lawyer for Kenneth Barrett asked the judge to postpone the trial, saying they couldn't be ready by January 3rd. Barrett was indicted last month in the September 1999 death of Trooper David "Rocky" Eales.

He was killed when he approached Barrett's cabin during a drug raid. Barrett was convicted earlier this year of first degree manslaughter in Eales' death. That was his second state trial; the jury deadlocked during the first trial.
