WASHINGTON (AP) -- The U.S. Supreme Court Monday rejected the appeal of a condemned Oklahoma killer. Patrick Murphy is on death row for killing George Jacobs in McIntosh County in 1999.
Murphy argued he should've been prosecuted in federal court rather than state court because he and Jacobs were members of the Creek Nation and he says the killing occurred on Creek land.
Murphy says even though none of the surface rights to the land is under Indian control it is still Indian land because a small fraction of the mineral rights is in Indian control.
The Supreme Court rejected the case without comment.
