PURCELL, Okla. (AP) -- The attorney for a Purcell man accused of killing a 10-year-old girl in a cannibalistic plot says he'll try to get the trial moved out of McClain County.
Defense attorney Silas Lyman for murder defendant Kevin Ray Underwood said during a hearing Thursday morning he'll file a change of venue motion before January 15th.
Underwood is charged with first-degree murder in the April death of Jamie Rose Bolin and prosecutors say they will seek the death penalty. The girl's body was found in a large plastic tub in a closet of Underwood's apartment just below the apartment where the girl lived with her father.
The death attracted nationwide attention but prosecutors say they believe a fair jury can be found in McClain County.
Judge Candace Blalock says jury selection for the murder trial could start June first but the date would likely be changed if the trial is moved.
