Two murder charges to be requested in killing of pregnant waitress

A suspect in a fatal shooting is expected in court today. The shooting happened in Hominy, shocking the community. And now a prominent citizen could face two counts of first degree murder. The question many are asking is why?

6 in the Morning reporter Omar Villafranca says less than two hours before the deadly shooting, Hominy Police say 63 year old Roy Westbrook walked into a pawnshop, passed a background check and bought a 9 millimeter handgun. Investigators say Westbrook then walked into a busy Hominy diner and shot Rebecca Clements who was pregnant, in front of a lunchtime crowd.

Investigators and residents in Hominy are still looking for answers. Police found Westbrook in his car a few blocks away, with a gun sitting on the passenger seat.

His arrest and the shooting have everyone in the small town talking. Hominy city manager Tex Bayouth: "It's a shocking situation in a small community of 3,000 people. People move to the small community for safety. It's very depressing and everybody knew Roy and a majority of the people knew the gal in the cafe because she had worked there for a while."

Last month, the Hominy newspaper published a letter written by Clements, suggesting Westbrook was responsible for vandalizing a home he owned. Clements sister was later evicted from the house. Police believe the dispute may have cost Rebecca Clements her life.

Investigators say based on evidence, the killing was pre-meditated. Westbrook isn't talking to investigators about the shooting.

He is expected to appear in a Pawhuska courtroom today.
