NORMAN, Okla. (AP) -- A judge says DNA evidence can be used against a man suspected of killing a University of Oklahoma dance student more than nine years ago.
Judge William Hetherington is rejecting a defense motion to prohibit the evidence in the first-degree murder trial of Anthony Sanchez in the death of Juli Busken.
Sanchez is also charged with kidnapping, rape and sodomy.
Sanchez's attorneys argued that his right to privacy was violated when DNA samples were taken from him while he was in prison in an unrelated case. The DNA samples matched evidence found with Busken's body.
Sanchez's trial is to begin Monday.
