FREDERICK, Okla. (AP) -- The former Tillman County sheriff wants his job back, but county commissioners say the matter is closed.

Billy Hanes on Tuesday attempted to withdraw a letter of resignation that commissioners accepted last week. Hanes told commissioners that his attorney wasn't authorized to submit the letter.

Commission chairman Joe Dickey says that after consulting with District Attorney John Wampler he considered the situation had been resolved.

Hanes and his brother, Randy, were charged with threatening a violent act based on race, or in the alternative, one count of assault and battery. They allegedly threatened to kill Velma Pollard, her 15-year old son, and every black person in Tillman County because of their race.

Officials say Hanes had wanted to confront Pollard's son about his relationship with the sheriff's 13-year old daughter.

An agreement to drop the charges included Hanes' resignation from office.

Hanes says his letter was to take effect under certain conditions, including that the charges be dismissed with prejudice, meaning they can't be refiled.

Prosecutors say the charges can be reinstated if Hanes doesn't comply.
