OKLAHOMA CITY (AP) -- Former state Insurance Commissioner Carroll Fisher wants a new judge to hear his upcoming trial on embezzlement and perjury charges.
Fisher's attorney says there are discrepancies in how cases are assigned in Oklahoma County and Judge Susan Caswell should not be in charge of the case and two others. Fisher has five felony cases pending and all are assigned to Caswell.
Prosecutors say Fisher is being treated no differently than any other defendant.
On the embezzlement and perjury charges Fisher is accused of taking a $1,000 donation to his campaign and putting it in his personal account and of never disclosing the donation on his campaign reports. The trial is scheduled to begin February 6th.
Fisher is also asking that the trial be moved out of Oklahoma County to either Newkirk, Ardmore or Ada.
