JAY, Okla. (AP) The family of a Kansas man who was fatally shot last year has filed a wrongful death lawsuit against the person who was found innocent of wrongdoing in the death.

Laramy O' Leary was tried for second-degree murder in September 2004 in connection with the January 11th, 2004, shooting of James Hansen.

The jury found O' Leary innocent and his records were expunged from the Delaware County Court Clerk's office.

Carol Sapp filed the complaint in the district court clerk's office, asking for $5.5 million in damages as well as all medical bills and funeral expenses. Sapp is the mother of Hansen's widow, Sarah Ann.

O'Leary is accused of acting carelessly, recklessly and negligently through the handling of a firearm, causing it to discharge and mortally wound Hansen with a shot to the head causing his death.
