A Tulsa woman who filed suit against a candy company thinks she won a very small victory.
She lost her sweet tooth, but won a cash settlement and now says she's going back to court.
News on 6 reporter Emory Bryan says while many people would see a box of chocolate as a golden package of chocolately goodness, Pam Partridge sees it as the reason she gave up candy.
When she bit into a "Pecan Delight" just before Valentines day, she found worms inside.
She lost her appetite, a day of work, and the cost of a doctor visit.
Because of that, she took Russell Stover Candies to small claims court - and won - but she doesn't feel like she won much.
"I feel like I actually lost," says Partridge.
She was awarded her expenses plus money for damages.
Afterward the judge changed his mind and cut the award down to actual costs to a total of $286.
She thinks Russell Stover should have to pay more for someone who ate wormy chocolate, so the company would make sure it doesn't happen again.
"It's never been about the finances," Partridge says. "It's been about getting everything exposed and fair treatment and I don't think I was treated fairly."
The company says when the candy is made, it's kept at sub zero temperatures, making it impossible for insects to exist.
The company confirmed bugs in the candy, but believes they got in there after it left the factory.
The Pecan Delight is a staple of Russell Stover's inventory, sold in boxes and individual pouches.
While many people love them, Pam Partridge is done with them but not the company.
She plans to appeal the judge's ruling, arguing the first and larger amount should have been the final decision.
