A Tulsa man was arrested on suspicion of DUI Saturday after an early morning crash that killed his 5-year-old son, the Muskogee Phoenix newspaper is reporting.
Cody Hamilton Welch, 33, was treated for his injuries and then booked into the Muskogee County/City Detention Facility on complaints of driving under the influence involving serious bodily injury, driving under suspension, possession of marijuana and child endangerment.
The Muskogee Phoenix reports the child, whose name has not been released, was flown to a Tulsa hospital, where he died late Saturday, according to Fort Gibson Police Chief Clint Vernon.
The paper reports Vernon has said vehicular homicide will be added to the complaints.
The crash happened around 4:10 a.m. Saturday on West Poplar Street, just west of Scott Street. Police said Welch drove left of center and overcorrected, causing his pickup truck to roll several times before it hit a tree. The paper reports the boy was ejected from the truck in the crash.
Court records show Cody Hamilton Welch pleaded guilty and received a deferred sentence for distribution of a controlled dangerous substance/possession with intent to distribute in 2010. And in 2004, Welch was convicted of driving under suspension and DUI.
