Gaming Commission Rejects Appeal Over Broken Arrow Casino

Developers of a casino in Broken Arrow hit another roadblock Thursday.

The National Indian Gaming Commission has rejected an appeal to allow gaming on the site near the Creek Turnpike.

The Kialegee Tribal Town is building the Red Clay Casino.

The two land owners were recently admitted as members of the Kialegees and the tribe asked the NIGC to overturn a ruling that said the tribe did not have jurisdiction over the land.

But the NIGC said the tribe has not provided any case law that gives the Kialegees legal jurisdiction. Meanwhile the state says the tribe is violating the injunction that bars any construction on the site.

The state says crews have spread gravel on the property for a parking lot, and a sign advertising fireworks for sale has been installed.
