The Oklahoma Highway Patrol arrested a Bartlesville man on a DUI complaint after the trooper stopped his car for a broken tail light.
Inside the car driven by 39-year-old Timothy McIntyre, the trooper found McIntyre's 7-year-old son asleep in the passenger seat.
According to an affidavit filed in Washington County District Court, the trooper said he stopped the car at 1:20 a.m. on U.S. Highway 75, just north of Dewey.
When the trooper approached the car, he noticed the smell of alcohol coming from the driver. After failing a field sobriety test, McIntyre was arrested on complaints of DUI and child endangerment.
The boy was turned over to the custody of a relative and McIntyre was taken to jail.
Bond for McIntyre was set at $15,000.
