Five people testified Wednesday, including two who were in the house when the fatal shot was fired.
Fleming's attorney says Theo shot his girlfriend by accident, but prosecutors are trying to prove otherwise.
One witness said Theo and Kaitlyn were sitting on the floor laughing and talking right before he heard the shot. He testified Theo jumped up, shock on his face and he yelled, "I shot her; we've got to get her to the hospital."
He said they put her into a car and drove as fast as they could, running red lights, to get her to the hospital three miles away. He told the jury they didn't think about calling 911, but just thought, they needed to get her help because she was hurt.
He admitted that Theo and others lied to police at first, telling them Kaitlyn was the victim of a drive-by shooting. He said Theo had bought the gun that day, to have for protection after getting beat up the night before.
The case continues Thursday.
