Woman Wants Child Abuse Case Thrown Out

There are new developments in a Claremore child abuse case. Roxann Barnard wants her case thrown out, claiming her arrest wasn't legal.

Barnard is facing a felony charge of permitting child abuse in the death of her four-year-old son Christopher. Her husband is in jail, accused of first degree murder.

A motion filed on Tuesday says Claremore police were outside their jurisdiction, when they arrested Roxann at her Owasso apartment.

A Rogers County judge will take up the matter in August.
